3 Things To Know About Photo Copyrights

With the amount of photos uploaded each day into Facebook, Instagram and other social media outlets, many users are still under the assumption of simple fact that just because they’re in the photo, they hold the copyright to the image.  This is especially common in wedding photography where actual wedding pictures are posted or used in websites and other advertorial purposes.

The fact is simple; the definition of the copyright holder is someone who has created the work of art - in this case, the photographer.

Here is what you should know.

1. Your photographer holds the copyrights to your photos automatically

Referring to the Intellectual Property Office of Singapore, the copyright holder is someone who"created the work (i.e. the author)". (See here for more information.)

This means that even if there is no agreement to allow the photographer to publish the images, he or she will have the rights to do anything he or she wants with your photos. This includes using them for editorial or advertorial purposes.

On a side note, it’s worth noting any photographer who cares about their reputation should first inform you before posting any of the photographs online.

2. If you want the rights, negotiate it.

Ask if your photographer's open to letting you have the rights to your photos for a fee, or share the rights, in which you both will have to agree on giving permission jointly. Note that granting you joint copyright of your photos can be a pricey affair which you will have to ultimately decide if having it is worth the investment.

3. License of use

If you're looking to share or circulate your photos by giving them to family members, friends and relatives, check if you can include a clause on license of use in your contract.

This allows you to disseminate them but keep in mind that you are usually not allowed to alter the final image in anyway without prior consent of the photographer. See here for more information.
